Not everyone knows what to do when faced with a criminal charge and it can cause a great deal of anxiety for most people. There are some steps you can take, however, to make sure that you don’t jeopardize your own criminal defense.
1. Don’t Talk To The Police
It is always a smart choice not to make any statements to the police. You have the right to remain silent. This means that you do not have to make any statements to the police and the only information you are required to provide, typically, is your name and date of birth. Police are used to dealing with people who will not answer questions. They may use tactics to try and get you to speak because their job is to gather evidence. Any statements you make to the police can be used against you in court, so it is better not to say anything.
2. Do Not Resist Arrest Or Run From The Cops
If you know you are being charged with a crime, it is a waste of your time to run away from the police. It is best to deal with the charges head-on. By resisting arrest or running from the police, you are only causing more problems for yourself. Not only is resisting arrest its own crime, but it can also be used as evidence that you knew you were guilty of the underlying offense. Fight your case, not the police officer who is arresting you.
3. Don’t Be Rude To The Police
Being arrested can be very upsetting, and it may be tempting to get angry with the police. But being disrespectful to the police won’t get you anywhere. Police officers can have a lot of say in the ultimate charges against you, so it is wise to be calm and respectful. Mouthing off can quickly change a misdemeanor into a felony
4. Don’t Speak To Anyone About Your Case
Do not talk to anyone but your lawyer about your case. This is especially true if you have been placed in jail awaiting trial. Phone calls home from jail are being recorded. Even if the conversation seems innocent, you would be surprised how words can be twisted. The same goes for anyone you might meet in jail. Other inmates will be questioned about anything you might say and could be asked to testify against you at trial.
5. Don’t Wait To Contact A Lawyer
When it comes to contacting a lawyer, it’s best to act as soon as possible. Handling a case, even a simple one, on your own is a bad idea. A good lawyer can help you win your case or greatly improve the outcome. You want your lawyer to be there from the beginning so contact someone as soon as possible.
