All Charges Dropped

DUI

Found in his parked car with a friend and some open bottles, our client was facing a fourth DUI offense, along with 3 years of prison time and 2 more for probation violation. We didn’t back down in court, and the state dropped all charges after a short recess. Our client did not receive jail time, points, or probation – and he only paid a $50 fine.

Probationary Deal on a Second Offense

DUI

Our client had a .18 BAC in a notoriously heavy-handed jurisdiction, Harford County, where people can easily do 60 days active time on a second offense. Our firm negotiated a plea deal for our client that achieved no conviction, no points, and no jail. The Judge was incredibly impressed with the mitigation package we presented on behalf of client, who was very pleased with the results.

No Jail Sentence

DUI

Our firm secured a no-jail sentence for our client from a very tough Judge in Frederick County. Our client blew a .20 on a third offense, and the prosecutor was asking for active jail time. The Judge said the mitigation package we devised for the client made all the difference and led him to ignore the prosecutor’s jail recommendation in favor of just probation.

Charge Reduced

DUI

One of our DUI clients was facing up to 1 year in jail if convicted, plus $1000 in fines, 12 points on her driving record, and 3 years of supervised probation. By negotiating with the prosecution, we were able to secure a much better result. Our client did not receive a conviction, points, or jail time – instead, she paid only a few hundred dollars and received 1 year of unsupervised probation.

Not Guilty

DUI

After his fifth DUI charge, our client was facing up to 3 years in prison for a conviction. By showing that the field sobriety test result was affected by the client’s disability, our defense attorneys were able to secure a “not guilty” verdict on all counts, after the jury deliberated for only 12 minutes.

Probationary Deal on Sixth Offense

DUI

After being arrested for their sixth DUI, our client faced 3 years in jail, up to $3,000 in fines, and a system inclined to award maximum penalties to repeat offenders. Our team managed to secure a probationary deal with no jail time for this client.

Those who meet board certification have proven they are superior to other lawyers through experience, scrupulous background checks, judicial and peer evaluations, and rigorous examination.

Types of Breath Tests in Maryland

Preliminary Breath Test V. Official Breath Test

When you are arrested on suspicion of driving under the influence (DUI), you may be given two separate breath tests. These tests determine your blood alcohol concentration (BAC).

In Maryland, if you are over the age of 21, a BAC of .07% or lower results in a driving while impaired (DWI) charge.

A BAC of .08% or higher could result in a driving under the influence (DUI) charge.

To determine your BAC, an officer will ask you to blow into a device that will read the amount of alcohol in your breath.

This test is given to you either at the location of the arrest (voluntary) or at the station (required).

Voluntary Preliminary Breath Tests

Frederick drivers who have been pulled over for suspicion of drunk driving may be asked to take a preliminary breath test after undergoing field sobriety tests.

This test is voluntary, and an officer must read you your rights. The purpose of this test is to give the officer cause to bring you to the station for a mandatory breath test.

Official Breath Test

The official, or mandatory, BAC test which can be used as evidence during the trial, occurs at the station.

Like the preliminary test,Maryland Law Section 16-205.1 to clearly explain to the driver his or her rights regarding the test.

The outcome of this test is typically the main source of evidence used by the authorities during a trial.

Disputing Breath Test Results

A skilled DUI defense lawyer may ask to review the history of the Breathalyzer and the last time of calibration.

It is crucial that the test is as accurate as possible, because the penalties for having a .07% BAC or a .08% BAC are very different.

If there is any concern that the test may be inaccurate, a judge may drop the charges.

What Should I Expect After My First DUI?

After a DUI, the arresting officer may confiscate your driver’s license if your BAC is greater than 0.08% (or if you refuse to submit to a breath test). The State of Maryland will then suspend your license.

The Maryland Motor Vehicle Administration will issue a 45-day temporary paper license in DUI cases. Your driving suspension begins after these 45 days.

You can request a hearing within 30 days of your license suspension. The MVA limits its review to specific factors, primarily the validity of the officer’s suspicion that you were driving under the influence.

An administrative law judge will uphold the officer’s actions and suspend your license if they determine the officer was justified.

In some cases, you may have the option to participate in the Ignition Interlock Program. This program permits you to drive with an installed device that monitors your alcohol level.

Frequently Asked Questions

DUI FAQ

What Are the Penalties for a DUI in Maryland?

The penalties for DUI vary based on the circumstances and how many prior DUI convictions you have. Penalties for Driving While Impaired (DWI), meaning a breath test showed 0.7% BAC or lower, are typically lower than DUI penalties.
First Offense:

  • DUI: Up to 1 year in jail, up to a $1,000 fine, up to a 6-month license suspension.
  • DWI: Up to 2 months in jail, up to a $500 fine,up to a 6-month license suspension.
    Second Offense
  • DUI: Jail time ranging from 5 days to 2 years, up to a $2,000 fine, up to a 12-month license suspension, and mandatory alcohol and drug assessment and treatment. You may also be required to participate in an Ignition Interlock Program.
  • DWI: Up to 1 year in jail, up to a $500 fine, up to a 9-month license suspension.
Penalties increase with each additional offense and are more severe when a minor is in the vehicle. You may also face collateral consequences such as employment challenges, higher insurance premiums, loss of professional licenses, and more.

What Defenses Can Be Raised if I’m Arrested on DUI Charges in Frederick?

There are many defenses available for DUI charges in Frederick. Your DUI attorney will develop a defense strategy based on the facts and circumstances of your case. The most common DUI defenses are:

  • Challenging the Traffic Stop: Was there a valid reason for the initial stop? If not, any subsequent evidence could be deemed inadmissible.
  • Disputing Test Accuracy: Breathalyzers and blood tests must adhere to strict procedures and calibration rules. Any deviation can cast doubt on the results. Field sobriety tests can also be unreliable depending on the conditions of the test.
  • Alternative Explanations for Alleged Intoxication: Symptoms associated with intoxication can have other causes, such as medical conditions or fatigue.
Identifying Procedural Errors: Mistakes in handling evidence or administering tests can cast doubt on the validity of the prosecution’s evidence.
  • Ultimately, a strong defense aims to create reasonable doubt about the prosecution’s case or expose errors in the state’s procedures. An experienced Frederick DUI attorney can thoroughly investigate your case and develop the most effective defense strategy.

Will My Driver’s License Be Suspended?

Yes, your license may be suspended after a DUI charge. The length of the suspension will depend on whether you have prior DUI convictions, with first-time offenders facing up to a six-month suspension and second-time offenders facing up to a 12-month suspension.

How Long is DUI Probation?

A DUI conviction in Maryland often comes with probation, usually lasting one to three years. The exact duration depends on the severity of your DUI charges.

While on probation, you’ll have certain obligations, which may include:

  • Avoiding alcohol and drugs
  • Participating in alcohol education classes or treatment for alcohol abuse.
  • Avoiding further criminal charges.
  • Undergoing random drug and alcohol screenings.
  • Community service.

Failing to meet these requirements can have serious consequences, including the possibility of jail time. It’s essential to have an attorney guide you through the probation process and ensure you understand and fulfill your obligations.

Can I Win a DUI Case Without a Lawyer?

Individuals who represent themselves could win their DUI case without a lawyer. However, this is not advisable. DUI defense often hinges on technical arguments related to the initial traffic stop, related procedural errors, and the validity of breath or blood tests. A sophisticated knowledge of DUI law is required to make these arguments to a court and challenge the prosecution’s case.

The stakes are too high to represent yourself. Hiring a DUI lawyer will increase your chances of a favorable outcome and give you peace of mind as they handle all aspects of your criminal defense.
