Maryland Drug-Impaired Driving Laws
Under Maryland Transportation Code Annotated § 21-902, it is illegal to drive or try to drive any vehicle while impaired by any drug, including prescription and over-the-counter drugs, or a combination of one or more drugs and/or alcohol. In addition, it is illegal to drive or try to drive any vehicle while impaired by a controlled dangerous substance. When a controlled substance is involved, further criminal charges may also apply, such as drug possession.

Penalties for Driving Under the Influence of Drugs
When a person is issued a Maryland driver’s license, that person agrees to follow all traffic laws, as well as to submit to a chemical test of breath, blood, or urine in the event of a suspected DUI arrest. Refusing this test could result in an automatic license suspension of 120 days.
