Maryland DUI Drugs Lawyers
With Law Offices in Lanham, Waldorf, Frederick, Lexington Park, Rockville, and Annapolis
Driving under the influence (DUI) of alcohol or drugs is very dangerous and causes thousands of injuries and fatalities every year. Although most DUI incidents involve driving under the influence of alcohol, driving while impaired by drugs can be just as or even more dangerous. That’s why a DUI of drugs conviction carries harsh and inconvenient penalties, including driver’s license suspension.
To avoid excessive and potentially unjust punishment, it is extremely important that a person arrested for driving under the influence of drugs contacts an experienced criminal defense attorney. Our DUI of drugs attorneys in Maryland have over 30 years of experience representing those individuals facing these serious charges.
Maryland Drug-Impaired Driving Laws
Under Maryland Transportation Code Annotated § 21-902, it is illegal to drive or try to drive any vehicle while impaired by any drug, including prescription and over-the-counter drugs, or a combination of one or more drugs and/or alcohol. In addition, it is illegal to drive or try to drive any vehicle while impaired by a controlled dangerous substance. When a controlled substance is involved, further criminal charges may also apply, such as drug possession.

Penalties for Driving Under the Influence of Drugs
When a person is issued a Maryland driver’s license, that person agrees to follow all traffic laws, as well as to submit to a chemical test of breath, blood, or urine in the event of a suspected DUI arrest. Refusing this test could result in an automatic license suspension of 120 days.
If you are arrested under suspicion of driving under the influence of drugs or controlled substances and are convicted, you may be subject to a number of penalties, including:
- Driver’s license suspension
- Fines
- Jail time
- Controlled dangerous substances charge
- Impounded vehicle
- Enrollment in a drug counseling program
If a person violates the state’s DUI law multiple times within five years, that person is considered a repeat offender and is subject to even more severe consequences.

Possible Defenses for DUI of Drugs
Law enforcement has zero tolerance for drivers who place other motorists in danger by being under the influence of drugs, and rightfully so. However, a person doesn’t actually need to be impaired by drugs to be arrested for driving under the influence. Often, drivers are left confused about why they were arrested. If a police officer suspects that you are under the influence of a drug and driving, or if you refuse to take a chemical test, then you can be arrested regardless of whether you are actually impaired by a drug or not. This is why it is imperative that you retain the services of an experienced DUI of drugs defense attorney in Maryland. Without one, you may be convicted of a crime you did not commit.
Sometimes, what makes a driver seem like he or she is under the influence is actually just bad driving, which has significantly fewer consequences than a DUI drugs arrest. Additionally, in their efforts to take dangerous drivers off the road, police officers can make mistakes in procedures that lead to an unlawful arrest.
Let Alpert Schreyer protect your rights and your future by crafting a strong and effective defense on your behalf. We are eager to get started on your case.
Client Reviews
The attorney’s and paralegals are incredible. They are truly committed to understanding your case and serving you. However, I’ve personally worked with Mr. Berman and Mrs. Bowman through my entire process! I am so grateful for their passion, dedication, and professionalism. I haven’t worked with many attorney’s in the past, but I’m glad you all were recommended to me. You all are truly the best. Thank you so much!
