Giving Your DUI Case a Strong Fighting Chance
Have you been charged with driving under the influence (DUI) in Rockville? If so, the road ahead may seem impossible to travel, as the state of Maryland prosecutes DUI charges very harshly. You could be facing the suspension of your license, expensive insurance rates, hefty fines, and jail time, among other penalties.
Don’t wait to reach out to a legal professional — the clock starts running as soon as you are arrested, so the earlier you get started, the better. Alpert Schreyer, LLC has advocated for individuals facing DUI charges in Maryland and DC for decades and have made a name for ourselves as one of the top-rated DUI defense teams in the state. We will employ all our skill and dedicate all our resources to protecting your future.
What to Know After Getting a DUI in Rockville
After being arrested for a DUI, make sure to read any paperwork that the police provide so that you know of any relevant deadlines. DUI cases are handled promptly through the justice system, meaning that if you put off reading even one piece of paperwork, you could easily miss the opportunity to save your license and avoid further penalty.
For instance, some individuals are legally required to request a Motor Vehicle Administration (MVA) hearing no later than 10 days after the date of their arrest, otherwise their license will be automatically suspended for anywhere between 45 and 120 days. Similarly, other individuals may be required to visit a commissioner within 3 to 5 days after arrest.
It is wise to consult an attorney regarding your case. It may be possible to represent yourself in court, but the legal system is notoriously difficult to navigate when you do not have a degree in law. A legal professional who has years of experience can make the whole process a lot easier by preventing you from missing any deadlines, advocating for you in court, and providing you with supportive legal counsel at every step of the way.
What Is BAC and Why Does It Matter?
Blood alcohol concentration (BAC) is utilized by police officers to determine a driver’s sobriety. Per law, a driver is considered too inebriated to drive if they have a BAC of 0.08% or more.
Police officers will measure a driver’s BAC through a preliminary breath test in which the driver must blow into a breathalyzer. While Rockville drivers have the right to refuse a preliminary breath test, doing so may give the officer cause to take them to the station. Once there, they are legally required to take an official breath test to gauge their BAC. The same is true for field sobriety tests — such as the one-leg stand test or the walk-and-turn test — you have the right to refuse them, but you could very well end up being taken to the station regardless.
Fortunately, preliminary breath tests are inadmissible in court, and there is no statute that requires a judge to deal out a harsher penalty to someone with a 0.14% BAC than they would to someone with only a 0.08% BAC. On the other hand, BAC will be considered during an MVA hearing and will be key in determining how long an ignition interlock device should remain installed in your vehicle. Typically, this ranges from 180 to 270 days.

The attorney’s and paralegals are incredible. They are truly committed to understanding your case and serving you. However, I’ve personally worked with Mr. Berman and Mrs. Bowman through my entire process! I am so grateful for their passion, dedication, and professionalism. I haven’t worked with many attorney’s in the past, but I’m glad you all were recommended to me. You all are truly the best. Thank you so much!
