Maryland has two degrees of assault. The circumstances and factors of your case will determine your charges. Each assault charge has different penalties for a conviction.

First-Degree Assault in Waldorf, MD

Maryland law defines first-degree assault as intentionally causing or attempting to cause serious bodily injury to another person. A person is also guilty of first-degree assault if they commit an assault with a firearm of any kind.

Alleging that the bodily injury suffered by the victim is not “serious” is one defense to first-degree assault. Not all physical injuries are serious. Generally, a serious injury creates a substantial risk of death or causes permanent or prolonged impairment or disfigurement.

The penalties for first-degree assault are severe. You can face up to 25 years in prison for a conviction. The court may also order fines, restitution, community service, probation, and other punishments.

Second-Degree Assault in Waldorf, MD

Second-degree assault is defined by law as all other types of assault that do not involve using a firearm or intentionally causing or attempting to cause serious bodily harm. Therefore, you can be convicted of assault in the second degree if you cause harmful or offensive contact with another person without their consent.

You can also be convicted of assault in the second degree if you intentionally create a fear of imminent harmful or offensive contact. The touching does not need to cause physical injury for you to be convicted of second-degree assault charges.

The law also applies to intentionally causing physical injury to a probation or parole agent performing their official duties.

The penalty for a felony second-degree assault on a police officer is up to ten years in prison and/or a maximum fine of $5,000. The court may also include probation, community service, and other penalties as part of the sentence.
