These punitive damages will not, however, apply to every drunk driving case.

This measure is specifically designed to punish repeat offenders and individuals who consumed a significant amount of alcohol. Only drivers who have a blood alcohol level of twice the legal limit and those who have a suspended or revoked license will face punitive damages. It also could apply to drivers who have a conviction, plea or sentence of probation within the last five years.
