Serious Consequences for a Serious Crime
Most DUI crimes are misdemeanors. Although the penalties vary, misdemeanor DUI crimes can include driving with a blood alcohol concentration (BAC) of 0.08 percent or causing an accident while under the influence of alcohol or drugs which results in life-threatening injuries to another person. Under § 2-504 and § 2-505, any person who is convicted of causing the death of another as the result of driving under the influence of alcohol or drugs is guilty of a felony and is subject to a maximum imprisonment of three years and/or a maximum fine of $5,000 if it is their first offense. Upon a second or subsequent conviction, the individual is subject to a maximum of five years imprisonment and/or a maximum fine of $10,000.
Additional penalties may include the suspension of your driver’s license, the installation of an ignition interlock device in your vehicle, impoundment of your vehicle, and/or completion of a drug/alcohol treatment program.
