Maryland Law – Crimes Against the Person
In Maryland, causing injury to another while driving under the influence of alcohol and/or drugs is considered a crime against the person, under § 3-211 of the state’s Criminal Law Code and carries harsh penalties. The law states that “a person may not cause a life-threatening injury to another as a result of the person’s negligently driving, operating, or controlling a motor vehicle or vessel while the person is under the influence of alcohol or under the influence of alcohol per se.”
Additionally, it is illegal for any person to cause a life-threatening injury as the result of their driving under the influence of a drug, or any combination of drugs.
Penalties for DUI Causing Injury in Maryland
If you are convicted of DUI causing injury, you will be subject to a number of penalties, in addition to the suspension of your driver’s license by the Motor Vehicle Administration (MVA). These penalties include:
- A misdemeanor charge;
- A maximum 2 year sentence of imprisonment; and/or
- A maximum $3,000 fine.
These penalties also apply to a DUI of a controlled substance causing injury. Depending on the circumstances of the crime, aggravating factors, such as prior convictions would likely result in additional or harsher, punishments, including installation of an ignition interlock device.
