All Charges Dropped

DUI

Found in his parked car with a friend and some open bottles, our client was facing a fourth DUI offense, along with 3 years of prison time and 2 more for probation violation. We didn’t back down in court, and the state dropped all charges after a short recess. Our client did not receive jail time, points, or probation – and he only paid a $50 fine.

Probationary Deal on a Second Offense

DUI

Our client had a .18 BAC in a notoriously heavy-handed jurisdiction, Harford County, where people can easily do 60 days active time on a second offense. Our firm negotiated a plea deal for our client that achieved no conviction, no points, and no jail. The Judge was incredibly impressed with the mitigation package we presented on behalf of client, who was very pleased with the results.

No Jail Sentence

DUI

Our firm secured a no-jail sentence for our client from a very tough Judge in Frederick County. Our client blew a .20 on a third offense, and the prosecutor was asking for active jail time. The Judge said the mitigation package we devised for the client made all the difference and led him to ignore the prosecutor’s jail recommendation in favor of just probation.

Charge Reduced

DUI

One of our DUI clients was facing up to 1 year in jail if convicted, plus $1000 in fines, 12 points on her driving record, and 3 years of supervised probation. By negotiating with the prosecution, we were able to secure a much better result. Our client did not receive a conviction, points, or jail time – instead, she paid only a few hundred dollars and received 1 year of unsupervised probation.

Not Guilty

DUI

After his fifth DUI charge, our client was facing up to 3 years in prison for a conviction. By showing that the field sobriety test result was affected by the client’s disability, our defense attorneys were able to secure a “not guilty” verdict on all counts, after the jury deliberated for only 12 minutes.

Probationary Deal on Sixth Offense

DUI

After being arrested for their sixth DUI, our client faced 3 years in jail, up to $3,000 in fines, and a system inclined to award maximum penalties to repeat offenders. Our team managed to secure a probationary deal with no jail time for this client.

Those who meet board certification have proven they are superior to other lawyers through experience, scrupulous background checks, judicial and peer evaluations, and rigorous examination.

Overview of DUI in Maryland

Driving Under the Influence (DUI)

This is the more severe of the two impaired driving offenses. A driver is considered to be driving under the influence if they have a blood alcohol concentration (BAC) of 0.08% or higher. Maryland refers to this as “under the influence per se,” meaning the driver is legally presumed to be impaired. It doesn’t matter if they don’t seem or act impaired.

Driving While Impaired (DWI)

In Maryland, driving while impaired is a charge that applies to drivers who show signs of impairment due to alcohol consumption, even if their blood alcohol concentration is below the legal limit for a DUI charge. Specifically, if a driver has a BAC of 0.07%, they can be charged with a DWI.

A driver may also face a DWI charge if they exhibit noticeable signs of impairment, such as erratic driving behaviors, failing field sobriety tests, or other indicators that their ability to operate a vehicle is compromised, regardless of their exact BAC level. While a DWI is considered less severe than a DUI, it is still a serious offense in Maryland.

If you are facing a DUI or DWI charge in Maryland, seeking legal representation can help you understand your rights and navigate the legal process to potentially reduce the charges or penalties involved.

Driving Under the Influence of Drugs

Maryland law also prohibits driving while impaired by:

  • Illegal drugs: Substances classified as controlled dangerous substances, such as marijuana, cocaine, or other illicit drugs.
  • Legal drugs: Prescription medications or over-the-counter drugs that can impair driving ability.
  • Combination of substances: Using alcohol in combination with other drugs or a combination of other substances.

Even if a drug is legal or prescribed, if it impairs your ability to drive safely, operating a vehicle under its influence is against the law

What Are the Penalties For DUI in Maryland?

All forms of drunk driving are serious offenses in Maryland and can result in significant legal consequences. Understanding the potential penalties associated with these charges is crucial for anyone facing such allegations.

First Offense DUI

For a first-offense DUI, you face the following consequences:

  • Fines and jail time: A first-time DUI conviction can lead to a fine of up to $1,000 and the possibility of up to one year in jail.
  • Points on driving record: 12 points will be added to your driving record.
  • License revocation: Your driver’s license may be revoked for up to 6 months.

The exact penalties will depend on the specifics of your case.

Second Offense DUI

If you’re convicted of a second DUI, you face:

  • Fines and jail time: For a second DUI offense, the penalties increase to fines up to $2,000 and a potential jail sentence of up to two years, with a mandatory minimum of five days in jail.
  • Points on driving record: 12 points will be added to your driving record.
  • License revocation: Your license may be revoked for up to one year.

If you are convicted of two DUIs within a five-year period, you will also face a mandatory license suspension followed by a required period of participation in the Ignition Interlock Program. You may also be required to undergo an alcohol abuse assessment and complete an appropriate treatment program.

First Offense DWI

For a first-offense DWI, you face the following consequences:

  • Fines and jail time: A first-time DWI conviction can result in a fine of up to $500 and up to two months imprisonment.
  • Points on driving record: 8 points will be added to your driving record.
  • License suspension: You may face a license suspension of up to 6 months.

If you are under the age of 21, a conviction will result in a one-year license suspension.

Second Offense DWI

Penalties increase for a second offense. Here’s what you will face:

  • Fines and jail time: A second DWI offense may lead to fines of up to $500 and up to one year in jail.
  • Points on driving record: An additional 8 points will be assessed on your driving record.
  • License suspension: You face a license suspension ranging from 9 to 12 months.

For drivers under 21, a second conviction results in a two-year license suspension. Ultimately, the penalties for DUI and DWI offenses in Maryland, are severe and can have long-lasting impacts on your life. Legal representation is crucial to navigate this situation and mitigate the consequences you face.

What Defenses Can Be Raised If I’m Arrested For DUI?

Contact Our Maryland Criminal Defense Firm

Unlawful Traffic Stop

Law enforcement officers must have reasonable suspicion or probable cause to make a traffic stop. If the officer lacked a valid reason to pull you over–for example, no observable traffic violation or erratic driving–the stop itself may be deemed illegal.

Any evidence gathered as a result of an unlawful stop, including breathalyzer or field sobriety tests, may be suppressed, weakening the prosecution’s case.

Inaccurate Breathalyzer Results

The accuracy of breathalyzer tests can be a significant point of contention in DUI criminal cases. Breathalyzer machines must be properly calibrated and maintained to provide reliable results. If the device was not correctly calibrated or if there were technical malfunctions, the BAC reading may be inaccurate. Additionally, certain medical conditions or substances can interfere with test results.

Rising Blood Alcohol Content

The timing of when you consumed alcohol in relation to when you were driving can be critical. Alcohol absorption into the bloodstream takes time. It’s possible that your BAC was below the legal limit while you were driving but increased by the time you took the breathalyzer test. This is known as the “rising BAC” defense.

Alternative Explanations for Observed Behavior

There may be innocent explanations for signs that officers interpret as impairment. Fatigue, anxiety, physical injuries, or illnesses can cause symptoms similar to those of alcohol impairment, such as bloodshot eyes, slurred speech, or unsteady balance. Providing evidence of such conditions can help refute the assumption that you were under the influence.

Lack of Evidence

Ultimately, the prosecution must prove beyond a reasonable doubt that you were driving under the influence if there is insufficient evidence to meet this burden–perhaps due to lack of reliable test results, questionable observations by the officer, or absence of corroborating evidence–a skilled attorney can argue for dismissal or acquittal based on reasonable doubt.
