Overview of DUI in Maryland

Driving Under the Influence (DUI)

This is the more severe of the two impaired driving offenses. A driver is considered to be driving under the influence if they have a blood alcohol concentration (BAC) of 0.08% or higher. Maryland refers to this as “under the influence per se,” meaning the driver is legally presumed to be impaired. It doesn’t matter if they don’t seem or act impaired.

Driving While Impaired (DWI)

In Maryland, driving while impaired is a charge that applies to drivers who show signs of impairment due to alcohol consumption, even if their blood alcohol concentration is below the legal limit for a DUI charge. Specifically, if a driver has a BAC of 0.07%, they can be charged with a DWI.

While a DWI is considered less severe than a DUI, it is still a serious offense in Maryland.
