All Charges Dropped

DUI

Found in his parked car with a friend and some open bottles, our client was facing a fourth DUI offense, along with 3 years of prison time and 2 more for probation violation. We didn’t back down in court, and the state dropped all charges after a short recess. Our client did not receive jail time, points, or probation – and he only paid a $50 fine.

Probationary Deal on a Second Offense

DUI

Our client had a .18 BAC in a notoriously heavy-handed jurisdiction, Harford County, where people can easily do 60 days active time on a second offense. Our firm negotiated a plea deal for our client that achieved no conviction, no points, and no jail. The Judge was incredibly impressed with the mitigation package we presented on behalf of client, who was very pleased with the results.

No Jail Sentence

DUI

Our firm secured a no-jail sentence for our client from a very tough Judge in Frederick County. Our client blew a .20 on a third offense, and the prosecutor was asking for active jail time. The Judge said the mitigation package we devised for the client made all the difference and led him to ignore the prosecutor’s jail recommendation in favor of just probation.

Charge Reduced

DUI

One of our DUI clients was facing up to 1 year in jail if convicted, plus $1000 in fines, 12 points on her driving record, and 3 years of supervised probation. By negotiating with the prosecution, we were able to secure a much better result. Our client did not receive a conviction, points, or jail time – instead, she paid only a few hundred dollars and received 1 year of unsupervised probation.

Not Guilty

DUI

After his fifth DUI charge, our client was facing up to 3 years in prison for a conviction. By showing that the field sobriety test result was affected by the client’s disability, our defense attorneys were able to secure a “not guilty” verdict on all counts, after the jury deliberated for only 12 minutes.

Probationary Deal on Sixth Offense

DUI

After being arrested for their sixth DUI, our client faced 3 years in jail, up to $3,000 in fines, and a system inclined to award maximum penalties to repeat offenders. Our team managed to secure a probationary deal with no jail time for this client.

Those who meet board certification have proven they are superior to other lawyers through experience, scrupulous background checks, judicial and peer evaluations, and rigorous examination.

Types of Tests for DUI Cases

What is the Legal Limit of BAC in Maryland?

The legal limit for alcohol consumption in Maryland is a blood alcohol concentration (BAC) of .08%. However, a driver who exhibits signs of intoxication can be arrested regardless of their BAC.

Breath Test

Breath Test are the most common and widely used method for detecting whether a driver has alcohol in their system. The driver blows into a handheld device, which can measure their BAC.

Field Sobriety Tests

Field Sobriety Tests (e.g., the horizontal gaze test, walk-and-turn test, and one-leg stand test) are performed on the roadside and are used to assess a driver’s motor skills and cognitive functions, which can be impaired by alcohol or drug use.

Blood Test

Blood tests can provide a more definitive measurement of alcohol or drugs in the bloodstream compared to breath tests, which can sometimes be subject to inaccuracies.

What Should I Expect After My First DUI?

After a DUI arrest in Maryland, the police officer may issue a Notice of Suspension. However, the Maryland Motor Vehicle Administration (MVA) will ultimately handle your license suspension following an administrative hearing. Once the police officer has filed the necessary paperwork to the Motor Vehicle Administration (MVA) after a traffic stop, you will have ten days to request a hearing to challenge the suspension.

Following the hearing, the MVA will review the police officer’s report and test results to determine whether to uphold your license suspension. If the MVA upholds the license suspension, you may have the option to request a hearing within 30 days to challenge the decision. It’s important to note that this process is separate from your criminal case. Your criminal case will proceed through criminal court, where your guilt or innocence will be determined.

Depending on the circumstances, a driver may be eligible to participate in the Ignition Interlock Program, which would allow them to continue driving under supervised conditions.

What Are the Penalties for a DUI in Rockville?

If you are facing your first DUI charge in Maryland, you may be facing serious criminal penalties, including jail time and fines. Here is a full list of possible DUI penalties:

  • First Offense: up to a year in jail, $1,000 in fines, and a six-month license suspension
  • Second Offense: five days to two years in jail, up to $2,000 in fines, and a 12-month license suspension
  • Third Offense: ten days to five years in jail, up to $5,000 in fines, and an 18-month license suspension

Possible DWI penalties could include:

  • First Offense: up to two months in jail, $500 in fines, and a six-month license suspension
  • Second Offense: up to a year in jail, $500 in fines, and a nine-month license suspension
  • Third Offense: up to five years in jail, $5,000 in fines, and a 12-month license suspension

Penalties increase with each additional offense and can be even more severe if a minor was in the driver’s vehicle.

What Defenses Can Be Raised if I’m Arrested on DUI Charges in Rockville?

There are a number of defenses that you can raise if you have been arrested on DUI charges. These include:

  • Improper Stop: If the police officer did not stop you based on reasonable suspicion, any evidence they obtained could be deemed inadmissible.
  • Lack of Probable Cause for Arrest: A police officer must have evidence to place a driver under arrest.
  • Inaccurate BAC Test Results: Breathalyzer and blood test results are not always accurate. Faulty equipment or the failure to follow proper procedures can result in inaccurate results.

Other defenses that can be raised include rising blood alcohol content from the time of the stop to the arrest and improper administration of a chemical test.

Will My Driver’s License Be Suspended?

There is a strong likelihood that your driver’s license will be suspended after an arrest. The length of your suspension will be determined by whether you have prior offenses. License suspensions can range from six months (first offense) to 18 months (third offense).

How Long is DUI Probation?

Typically, probation for a DUI ranges from one to three years. While you’re on probation, you will have certain obligations, including:

  • Avoiding alcohol and drug
  • Avoiding other criminal charges
  • Participating in alcohol education classes
  • Community service

Failure to meet the probation requirements can result in further criminal penalties. Meeting with an attorney is essential to understanding and navigating the probation process.

Can I Win a DUI Case Without a Lawyer?

It is possible for individuals without a lawyer to win their DUI case. However, these cases can be highly technical, nuanced, and reliant upon evidence concerning traffic stops, procedures, and the validity of a field sobriety or breath test. Understanding the intricacies of Maryland’s DUI laws is essential to crafting a formidable legal defense.

Hiring an experienced DUI lawyer may increase your chances of a positive outcome. They can handle all the facets of your case, giving you peace of mind.
